New post-study work arrangements for international students are now available

Changes have been made to the Temporary Graduate (subclass 485) visa to introduce new post-study work arrangements for certain graduates of an Australian bachelor’s, master’s or doctoral degree.

The subclass 485 visa now provides recent graduates with the opportunity to spend more time in Australia following their studies to gain practical work experience to accompany their Australian qualification(s).

Significant changes were made to the subclass 485 on 23 March 2013. Subclass 485 visa applicants must now apply in either the Graduate Work stream or the Post-Study Work stream. Each stream of the subclass 485 visa has its own specific requirements that applicants must satisfy for their application to be successful.

The Graduate Work stream is for international students who have recently graduated with skills and qualifications that relate to an occupation in demand in the Australian labour market, as determined by the Skilled Occupation List.

The Post-Study Work stream is for international students who have recently graduated with a bachelor’s, master’s or doctoral degree from an Australian educational institution, regardless of their field of study. This stream of the subclass 485 is only available to international students who applied for and were granted their first Australian student visa on or after 5 November 2011, which is the day the genuine temporary entrant requirement was introduced in the student visa program.

If you are applying for a subclass 485 visa, you now need to provide evidence with your application of having health insurance to cover your stay in Australia.

Hi! I have been waiting for this new visa to come out for some time now. I am currently on a 573 visa, completing a 1.5 year course. Would taking another masters degree allow me to complete the 2 year requirement? Is it OK if I go to another university?

Thanks for your question. The two year Australian study requirement is defined as study in Australia for at least two academic years (92) weeks. The study must have been conducted in English and completed in no less than 16 calendar months. You do not need to stay in one university to meet the two year Australian study requirement.

Hi, just wondering, whether any graduates apply for this visa in this current time if the eligible applicant are international students who applied for and were granted their first Australian student visa on or after 5 November 2011.

So, for example, this visa will be applicable for a PhD graduate (who is recognised as genuine entrant) i.e. in 2014, after they graduate.

I hope there are other alternative assessments to assess the genuine temporary entrant, so that the current PhD graduates can also apply the post-study work visa.

You must have attained this degree from a registered Australian educational institution, but it does not have to be from a university. Graduates of Australian TAFEs and other higher education providers who offer degree level qualifications might also be eligible for the Post-Study Work stream.

It is important to remember that a student visa is a temporary visa. There is no guarantee that, on the basis of having held a student visa, you will meet the requirements for a permanent residence visa.

The new Post-Study Work stream of the subclass 485 is only available to those people who applied for (and were later granted) their first student visa to Australia on or after 5 November 2011. This means that, if you were granted your first ever student visa to Australia on the basis of a visa application that was made before 5 November 2011, you will not be eligible for the Post-Study Work stream.

I understand that this stream is available for students that were granted their first visa to enter Australia on or after the 5 Nov 2011. However, what happens to students that were studying English in preparation for university studies, who entered Australia on a subclass 570 visa, and then applied/y for a 573 visa after the cut-off date. Wouldn't they be subject to the new genuine entrant criterion, and hence, should be allowed to apply for the PSW upon completion of their course?

Furthermore, what happens to students that had a student visa issued before the 5 Nov 2011, who then return home, and then decide to pursue tertiary education in Australia. Would they also be limited from applying for the PSW visa since they had their first student visa granted before the cut-off date?

It seems to me that that this would be very unfair on those students.

As you may be aware, in 2011 the Hon Michael Knight AO conducted the Strategic Review of the Student Visa Program 2011 (the Knight Review). A core principle of the Knight Review was to encourage a greater flow of international students to Australia while maintaining the integrity of Australia’s migration program. One of the key recommendations that arose from the Knight Review was the introduction of a Genuine Temporary Entrant requirement (GTE) in the Student Visa Program. The GTE was introduced on 5 November 2011.

The other reforms to the Student Visa Program that arose form the Knight Review, including the new post-study work arrangements, depend on the GTE as the cornerstone for the integrity of the program. These reforms would not have been possible without the introduction of the GTE.

For this reason, the Post-Study Work stream of the subclass 485 is only available to those international students who applied for and were granted their first student visa to Australia on or after 5 November 2011. This includes any student visas to Australia including subclasses 570, 571, 572, 573, 574, 575, 576 or 580.

International students who applied for their first Student visa to Australia before 5 November 2011 might still be eligible to apply for a Temporary Graduate Visa (subclass 485) in the Graduate Work stream, provided they graduate with skills and qualifications that relate to an occupation on the Skilled Occupation List (SOL).
